1.Description of Services

Toloo is an AI-powered emotional support companion designed to provide young people with a private, judgment-free space to discuss their mental and emotional wellbeing. The Services include an AI companion chat, mood check-in features, crisis resources, and related functionality.

Toloo is not a medical service, therapy practice, psychiatric service, or crisis intervention service. Nothing in the Services constitutes medical advice, clinical diagnosis, or professional treatment of any kind. The Services are a supportive tool designed to complement — not replace — professional mental health care.

2.Eligibility & Age Requirements

The Services are available to users aged 13 and above. By accessing the Services, you represent and warrant that you are at least 13 years of age.

Users under 16 (EU/EEA): If you are under 16 and located in the EU or EEA, you represent that your parent or legal guardian has reviewed and consented to these Terms on your behalf, as required by GDPR Article 8.

Users under 13: The Services are not intended for children under 13. We do not knowingly collect personal data from children under 13.

Toloo reserves the right to suspend or terminate access for any user who misrepresents their age.

3.Crisis & Emergency Situations

Toloo provides in-app access to emergency and crisis resources at all times. However, Toloo is not a substitute for emergency services and cannot dispatch help or guarantee a real-time response.

If you or someone else is in immediate danger, contact emergency services immediately.

4.User Responsibilities

By using the Services, you agree to:

  • Use the Services only for their intended purpose — emotional wellbeing and support
  • Not attempt to misuse, reverse-engineer, scrape, or exploit the Services or its underlying AI
  • Not use the Services to harm, harass, threaten, or abuse yourself or others
  • Not use the Services for any unlawful purpose under applicable EU or local law
  • Provide accurate information during onboarding, particularly regarding age
  • Not share your login credentials or permit others to access your account
5.AI-Generated Content

Toloo's responses are generated by Claude, an AI model developed by Anthropic. While we work carefully to configure the AI to be warm, safe, and appropriate, AI-generated content may not always be accurate, complete, or suitable for every individual situation.

AI responses are not a substitute for professional advice. If you receive a response that feels harmful or inappropriate, please contact us immediately.

6.Privacy & Data Protection

Your privacy is fundamental to Toloo. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We comply with the GDPR as an EU-based service, and with the CCPA for users in California. We do not sell personal data under any circumstances.

7.Intellectual Property

All content, design, branding, technology, and materials within the Services are the intellectual property of Toloo and its founder, protected by applicable EU intellectual property law. You may not copy, reproduce, or create derivative works from any part of the Services without express written permission.

Your conversation content remains yours. By using the Services, you grant Toloo a limited, non-exclusive licence to process your content solely to provide the Services as described in the Privacy Policy.

8.Disclaimers & Limitation of Liability

The Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

To the fullest extent permitted by applicable EU law, Toloo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services.

Toloo accepts no liability for harm or damages arising from a user not seeking professional mental health support or emergency services when such support is needed. If you are in crisis, please contact emergency services immediately.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under EU consumer protection law.

9.Indemnification

You agree to indemnify and hold harmless Toloo and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your violation of these Terms, your misuse of the Services, or your violation of any applicable law.

10.Termination

Toloo reserves the right to suspend or permanently terminate your access to the Services at any time for any violation of these Terms or conduct that may harm Toloo or its users.

You may terminate your account at any time by deleting it. Upon termination, your personal data will be deleted within 30 days in accordance with our Privacy Policy.

11.Changes to These Terms

We reserve the right to modify these Terms at any time. We will update the “Last updated” date when changes are made. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

12.Governing Law & Dispute Resolution

These Terms are governed by the laws of the European Union and applicable EU member state legislation. Any disputes shall be subject to the jurisdiction of EU courts.

For EU consumers, mandatory statutory rights under EU consumer protection law are not affected by these Terms. If you have a concern, please contact us first so we can resolve it directly.

13.Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
