These Terms of Service (“Terms”) govern your access to and use of Toloo's website and services (the “Services”), operated by Toloo (“we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services. Nothing in these Terms overrides or limits your mandatory rights under Swedish or EU consumer protection law.

1.Description of Services

Toloo is an AI-powered emotional support companion designed to provide a private, judgment-free space to discuss mental and emotional wellbeing. The Services include an AI companion chat, mood check-in features, crisis resources, and related functionality.

Toloo is not a medical service, therapy practice, psychiatric service, or crisis intervention service. Nothing in the Services constitutes medical advice, clinical diagnosis, or professional treatment of any kind. The Services are a supportive tool designed to complement — not replace — professional mental health care. You are solely responsible for seeking professional or emergency help when your situation requires it. Toloo accepts no liability for harm arising from a failure to seek such support.

2.Eligibility & Age Requirements

The Services are available to users aged 13 and above. By accessing the Services, you represent and warrant that you are at least 13 years of age.

Users under 16 (EU/EEA): If you are under 16 and located in the EU or EEA, you represent that your parent or legal guardian has reviewed and consented to these Terms on your behalf, as required by GDPR Article 8. At registration, users under 16 are required to confirm via a dedicated consent checkbox that their parent or legal guardian has reviewed and agreed to these Terms. This confirmation creates a record of the consent claim. If a minor accesses the Services without the required parental or guardian consent, the parent or legal guardian of that minor accepts full responsibility for any consequences arising from that access.

Users under 13: The Services are not intended for children under 13. We do not knowingly collect personal data from children under 13. If we become aware of such use, we will terminate the account and delete all associated data immediately.

Toloo reserves the right to suspend or terminate access for any user who misrepresents their age.

3.Crisis & Emergency Situations

Toloo provides in-app access to emergency and crisis resources at all times. However, Toloo is not a substitute for emergency services and cannot dispatch help or guarantee a real-time response.

If you or someone else is in immediate danger, contact emergency services immediately. Do not rely on Toloo in an emergency situation.

4.User Responsibilities

By using the Services, you agree to:

  • Use the Services only for their intended purpose — emotional wellbeing and support
  • Not attempt to misuse, reverse-engineer, scrape, or exploit the Services or its underlying AI
  • Not use the Services to harm, harass, threaten, or abuse yourself or others
  • Not use the Services for any unlawful purpose under applicable Swedish, EU, or local law
  • Provide accurate information during onboarding, particularly regarding age
  • Not share your login credentials or permit others to access your account
  • Not attempt to circumvent any security, access control, or payment mechanism
  • Not upload or transmit malicious code, viruses, or disruptive content
5.AI-Generated Content

Toloo's responses are generated by an AI model. The AI companion is not a human, not a therapist, and not a licensed mental health professional. While we work carefully to configure the AI to be warm, safe, and appropriate, AI-generated content may occasionally be inaccurate, incomplete, or unsuitable for your individual situation.

Your conversation data is never used to train AI models. It is used solely to generate responses within your session and to maintain conversation continuity where enabled.

AI responses are not a substitute for professional advice. If you receive a response that feels harmful or inappropriate, please contact us immediately at hello@toloo.io.

No memory between sessions: The AI companion has no memory between separate sessions unless the memory feature is explicitly enabled. This means the AI will not remember anything you shared in a previous conversation — including any crisis situations or sensitive disclosures. You should never assume Toloo remembers your history. Do not rely on Toloo for ongoing crisis support — always contact a real professional when needed. You may opt out of AI personalisation at any time by contacting hello@toloo.io.

6.Privacy & Data Protection

Your privacy is fundamental to Toloo. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We comply with the GDPR as an EU-based service. We do not sell personal data under any circumstances.

By using the Services, you consent to the processing of your personal data as described in the Privacy Policy. You may withdraw consent at any time by deleting your account.

7.Intellectual Property

All content, design, branding, technology, and materials within the Services are the intellectual property of Toloo, protected by applicable EU and Swedish intellectual property law. You may not copy, reproduce, or create derivative works from any part of the Services without express written permission.

Your conversation content remains yours. By using the Services, you grant Toloo a limited, non-exclusive licence to process your content solely to provide the Services as described in the Privacy Policy.

The Toloo name, logo, and brand are trademarks of Toloo. You may not use them without our prior written consent.

8.Payments & Subscriptions

Certain features of the Services require payment of fees. All payments are processed securely by our authorised payment provider, details of which are presented at checkout.

  • Subscription Plans: Toloo offers free and paid subscription tiers. Details about each plan, including pricing and usage limits, are described on our pricing page at toloo.io/pricing.
  • Free Trial: No free trial currently exists. One may be introduced in the future, in which case these Terms will be updated accordingly.
  • Billing Cycle: Subscription fees are billed at the start of each billing cycle — monthly or annually depending on your chosen plan. You authorise us to charge your payment method automatically for any renewal periods.
  • Renewal Reminders: For annual subscriptions, we will send you a reminder email at least 7 days before your renewal date. For monthly subscriptions, renewal occurs automatically at the end of each billing month. You may cancel at any time before renewal to avoid the next charge.
  • Digital Content Access: By requesting immediate access to the Services upon purchase, you acknowledge that performance of the contract begins immediately. You may waive your 14-day EU withdrawal right by ticking the confirmation checkbox at checkout. If you do not tick the checkbox, the standard 14-day withdrawal right applies.
  • Price Changes: We reserve the right to modify subscription fees at any time. We will provide at least 30 days' notice of any price increase before it takes effect. Your continued use after the notice period constitutes acceptance of the new price.
  • Failed Payments: If a payment fails, we may suspend access to paid features until payment is successfully processed. We will notify you by email if a payment fails.
  • Taxes: Prices shown include applicable VAT where required by EU law. You are responsible for any additional local taxes that may apply in your jurisdiction.
  • Currency: Prices are displayed in the currency applicable to your region. Final charges may vary slightly due to conversion by your payment provider.
9.Refund & Cancellation Policy

7-day refund eligibility: You may request a refund within 7 days of your initial purchase, provided you have sent fewer than 30 messages to the AI companion. Each AI response generated on your behalf incurs a real third-party processing cost. Where usage has exceeded 30 messages, the service has been materially delivered and refunds are not available. We assess usage based on our own server-side records, which are the authoritative source.

  • Requesting a refund: Contact us at hello@toloo.io within 7 days of purchase with your order details. This is the only method of requesting a refund. We will process eligible refunds within 5–10 business days.
  • After 7 days: Refunds after the 7-day period are not available except where required by applicable Swedish or EU consumer protection law.
  • Cancellations: You may cancel your subscription at any time from your account settings or by contacting us. Cancellations take effect at the end of the current billing period and you retain full access until then.
  • No partial refunds: We do not provide partial refunds for unused portions of a billing period unless required by applicable EU or Swedish consumer protection law.
  • EU statutory rights: Nothing in this refund policy limits your statutory rights under EU or Swedish consumer protection law.
  • Chargebacks: If you initiate a chargeback with your bank or card provider without first contacting us at hello@toloo.io, we reserve the right to suspend your account pending resolution.
10.Disclaimers & Limitation of Liability

The Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

To the fullest extent permitted by applicable Swedish and EU law, Toloo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services.

Toloo accepts no liability for any harm, loss, or damages — physical, psychological, financial, or otherwise — arising directly or indirectly from a user's failure to seek professional mental health support or emergency services when such support was needed. By using the Services, you explicitly accept responsibility for seeking professional or emergency help when your situation requires it.

Our total liability to you for any claim arising from these Terms or the Services shall not exceed the amount you paid to us in the 12 months preceding the claim. For users on the free tier who have made no payments, our total liability shall not exceed €100 in aggregate.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Swedish or EU consumer protection law.

11.Indemnification

To the extent permitted by applicable Swedish and EU consumer protection law, you agree to indemnify and hold harmless Toloo and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your material violation of these Terms; (b) your wilful misuse of the Services; or (c) your violation of any applicable law. This clause does not apply to any claim arising from Toloo's own negligence, breach of contract, or failure to comply with applicable law, and does not override any mandatory rights you hold as a consumer under Swedish or EU law.

12.Termination

Toloo reserves the right to suspend or permanently terminate your access to the Services at any time for any material violation of these Terms or conduct that may harm Toloo or its users.

You may terminate your account at any time by deleting it. Upon termination, your personal data will be deleted within 30 days in accordance with our Privacy Policy.

Upon termination for any reason, all licences granted to you under these Terms will immediately cease. Sections that by their nature should survive termination will do so, including Sections 7, 10, 11, and 17.

13.Force Majeure

Toloo shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, fire, floods, accidents, industrial disputes, or failures of third-party infrastructure providers.

In such circumstances, we will notify you as soon as reasonably practicable and resume performance as soon as the force majeure event ceases.

14.Third-Party Services & Links

The Services may contain links to or integrations with third-party websites, services, or content. These are provided for convenience only and do not constitute endorsement by Toloo.

  • We are not responsible for the content, privacy practices, or terms of any third-party service
  • Your use of third-party services is governed by their own terms and privacy policies
  • Third-party services we use include Anthropic (AI processing), Supabase (data storage), and Vercel (hosting)
  • We are not liable for any loss or damage arising from your use of third-party services
15.Accessibility

We are committed to making the Services accessible to all users, including those with disabilities, in accordance with applicable EU accessibility standards. If you experience any accessibility barriers, please contact us at hello@toloo.io and we will do our best to accommodate your needs.

16.Changes to These Terms

We reserve the right to modify these Terms at any time. We will update the “Last updated” date when changes are made.

For material changes, we will notify you by email or by displaying a prominent notice within the Services at least 14 days before the changes take effect. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the Services and may request account deletion.

17.Governing Law & Dispute Resolution

These Terms are governed by the laws of Sweden and applicable European Union legislation. Any disputes shall be subject to the exclusive jurisdiction of Swedish courts, without prejudice to any mandatory consumer rights you hold under the law of your country of residence.

Informal resolution: Before initiating any formal dispute process, we encourage you to contact us at hello@toloo.io. We commit to responding within 14 days and making a genuine effort to resolve the matter informally.

Online dispute resolution: EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr for resolving disputes related to online purchases.

Swedish alternative dispute resolution: Swedish consumers may also contact the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN) at arn.se.

18.EU & Swedish Consumer Rights

If you are a consumer located in Sweden or the EU/EEA, you have additional statutory rights that these Terms do not limit or exclude:

  • Right of withdrawal: Under EU Directive 2011/83/EU and Swedish consumer law, you have a 14-day right of withdrawal from digital service contracts. Where you have expressly requested immediate access at checkout and ticked the confirmation checkbox, you acknowledge that the service has begun and the right of withdrawal may be waived. This is explained clearly at the point of purchase.
  • Consumer protection: Swedish and EU consumer protection law applies to your use of the Services and cannot be waived by these Terms. Nothing in these Terms is intended to limit any right you have under mandatory Swedish or EU law.
  • Conformity: Digital services must conform to the contract. If the Services do not conform, you have the right to remedy, price reduction, or termination under EU Directive 2019/770 and applicable Swedish law.
  • Complaints: Swedish consumers may also contact the Swedish Consumer Agency (Konsumentverket) at konsumentverket.se or ARN at arn.se.

Your consumer rights are always preserved. Nothing in these Terms — including the indemnification clause in Section 11, the limitation of liability in Section 10, or the refund policy in Section 9 — is intended to override, limit, or waive any mandatory rights you hold as a consumer under Swedish law or EU Directives 2011/83/EU and 2019/770. Where any provision of these Terms conflicts with mandatory consumer law, the law prevails.

19.Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable Swedish or EU law, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

20.Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Toloo regarding your use of the Services and supersede all prior agreements, representations, and understandings.

No waiver of any provision of these Terms shall be effective unless made in writing. Our failure to enforce any right or provision shall not be considered a waiver of that right or provision.
